3D Aircraft Models is a brand of Luckyplane S.n.c.

2. Scope

These General Terms and Conditions govern purchases made through the 3D Aircraft Models website.

Before placing an order, customers are asked to read these Terms and Conditions carefully, together with the Shipping and Returns page, the Privacy Policy and the information provided on each product page.

By submitting an order, the customer confirms that they have read and accepted the terms applicable to the purchase.

A consumer is a natural person purchasing for purposes unrelated to their business, commercial, craft or professional activity. Consumers are entitled to the mandatory protections provided by applicable consumer law. Sales to professionals or businesses may be subject to different rules, within the limits permitted by law.

For distance contracts, the seller must provide clear pre-contractual information concerning the main characteristics of the goods, the seller’s identity, prices, payment and delivery methods, the statutory guarantee and the right of withdrawal, where applicable.

3. Products

The catalog may include:

  • 3D resin kits designed or produced directly by 3D Aircraft Models;

  • plastic and resin kits produced by third-party manufacturers;

  • conversion kits;

  • detail sets;

  • decals and masks;

  • diorama accessories;

  • other products related to aircraft scale modelling.

The main characteristics of each item are described on its product page.

Product images are provided for illustrative purposes. Colours, packaging and minor details may vary slightly because of screen settings, manufacturer updates or the inherent characteristics of craft production and 3D printing, provided that such differences do not affect the product’s essential characteristics or conformity.

For third-party products, packaging, artwork, decals or components may be updated by the manufacturer without prior notice. If a substantial change occurs, the customer will be informed before the order is processed.

Model kits contain components intended for scale modellers and may require tools, adhesives, paints or other materials that are not included unless otherwise stated on the product page.

4. Prices

All prices shown on the website are expressed in euros and include applicable VAT unless otherwise indicated.

Shipping charges and any additional costs are displayed separately before the customer confirms the order.

For deliveries outside the European Union, any customs duties, import taxes, customs-clearance charges or other fees imposed in the destination country are payable by the recipient, unless otherwise stated during checkout.

3D Aircraft Models may change its prices at any time. The price applicable to an order is the amount displayed before the customer confirms payment.

In the event of an obvious error in the price or other financial information, the customer will be contacted before the order is processed. The customer may confirm the purchase at the correct price or cancel the order and receive a full refund of any amounts already paid.

5. Ordering process and conclusion of the contract

To make a purchase, the customer selects the products, adds them to the basket, enters the required information, chooses from the available delivery and payment options, and confirms the order.

Before submitting the order, the customer can review and correct the information entered.

An order submitted by the customer constitutes an offer to purchase. The automatic order confirmation confirms that the system has received the order, but does not necessarily mean that the availability of every product has already been verified.

The contract is concluded when the customer receives confirmation that the order has been accepted or that its preparation has begun. 3D Aircraft Models may reject or cancel an order and fully refund any amounts already received in the following circumstances:

  • the product is no longer available;

  • the payment details are invalid or payment is not authorised;

  • the required information cannot be verified;

  • there is an obvious error in the price or description;

  • there are reasonable grounds to suspect fraudulent use of the website;

  • it has become impossible to fulfil the order.

The customer will be informed of any product unavailability as soon as reasonably possible.

6. Availability and processing times

Kits produced directly by 3D Aircraft Models are normally prepared for shipping within 7 days of the order date.

Plastic kits, third-party resin models and other items may be available from stock, ordered from the supplier after purchase, or shipped directly by the manufacturer or distributor.

The estimated times are stated on each product page and form part of the pre-contractual information relating to the purchase.

When an order contains items with different availability times, it may be shipped once all products are ready, unless alternative arrangements have been agreed with the customer.

7. Payments

Customers may use the payment methods displayed during checkout.

Payment authorisation and processing are handled by the relevant payment-service providers in accordance with their own terms and conditions.

An order may be suspended or cancelled if payment is not authorised, remains incomplete or requires additional verification.

Where a transaction is handled by authorised external services, 3D Aircraft Models does not directly store complete payment-card details.

8. Shipping and delivery

Available delivery methods and the related costs are displayed during checkout.

The times stated on product pages refer to the preparation, production or sourcing of the item and must be added to the carrier’s standard transit time.

The customer is responsible for providing a correct and complete delivery address. Any costs caused by an incorrect address, an uncollected parcel or an unjustified refusal of delivery may be charged to the customer, within the limits permitted by law.

The risk of loss or damage passes to the consumer when the consumer, or a third party appointed by them other than the carrier, takes physical possession of the goods. This does not apply where the consumer independently appoints a carrier not offered by the seller.

9. Right of withdrawal

Consumers may withdraw from a purchase within 14 days of delivery, without giving a reason, in the cases and under the procedures provided by the legislation governing distance contracts.

The withdrawal request must be sent to: customer-service@3daircraftmodels.it and must include the order number and the items concerned. The goods must be returned within 14 days of the withdrawal notice. Unless otherwise agreed or required by law, the direct return costs are payable by the customer.

The product may be inspected only to the extent necessary to establish its nature, characteristics and contents. The consumer is responsible for any reduction in value caused by handling beyond what is necessary for that purpose.

The return conditions, address, refund procedures and specific rules applicable to model kits are described on the Shipping and Returns page, which forms an integral part of these Terms and Conditions.

10. Refunds

Refunds will be made using the same payment method used for the original purchase, unless otherwise agreed.

The refund will be processed without undue delay and no later than 14 days after receipt of the withdrawal notice. The seller may withhold the refund until the goods have been received or until the consumer provides evidence that they have been returned, whichever occurs first.

When the withdrawal concerns the entire order, the original standard delivery costs will also be refunded. Additional costs resulting from the customer’s choice of a more expensive delivery service than the standard option offered will not be refunded.

Any reduction in the value of the product caused by unnecessary handling may be deducted from the refund within the limits permitted by law.

11. Statutory guarantee of conformity

Consumers are entitled to the statutory guarantee of conformity provided by applicable consumer law.

The seller is responsible for conformity defects that existed at the time of delivery and become apparent within the period established by law. Applicable European legislation provides remedies that may include bringing the goods into conformity, a price reduction or termination of the contract in the circumstances provided by law.

If components are missing, the product has a manufacturing defect, or damage is clearly attributable to transport, the customer must contact: customer-service@3daircraftmodels.it

The customer must provide the order number, a description of the problem, clear photographs of the product and, where necessary, photographs of the box and outer packaging.

For kits produced directly by 3D Aircraft Models, parts confirmed as missing, defective or damaged before delivery will be replaced.

Damage caused after delivery by incorrect assembly, improper cutting or removal, unsuitable tools or products, modifications, impacts, accidental drops, improper storage or other actions carried out by the customer is not considered an original defect.

When the cause is unclear, additional information or the return of the affected component may be requested for inspection.

12. Incorrect items

If the customer receives an item other than the one ordered, they must contact customer service without using, modifying or beginning assembly of the product.

After verification, 3D Aircraft Models will provide the necessary return instructions and arrange a replacement or another agreed solution at no additional cost to the customer.

13. Responsibility for product use

Kits and accessories must be used for their intended purpose and with the normal precautions required for scale-modelling activities.

Customers must follow the instructions and warnings supplied by the manufacturer, particularly when using tools, adhesives, solvents, resins, paints or other materials.

3D Aircraft Models is not liable for damage resulting from improper use, incorrect assembly, modification of components, failure to follow instructions or the use of incompatible materials, except where liability cannot legally be excluded.

Products are not toys unless expressly stated otherwise. Small, sharp or fragile parts may make them unsuitable for children. Use by minors must take place under adult supervision and in accordance with the instructions supplied with the product.

14. Intellectual property

Trademarks, logos, texts, photographs, drawings, graphics, files, models, designs and other content appearing on the website belong to Luckyplane S.n.c., the respective manufacturers or other rights holders.

Purchasing a product does not transfer any intellectual-property rights in the related designs, drawings or content to the customer.

Without prior written permission, website content and product designs created by 3D Aircraft Models may not be reproduced, copied, modified, distributed, resold or used commercially.

Third-party trademarks and manufacturers’ names are used solely to identify the products offered for sale and remain the property of their respective owners.

15. Accounts and proper use of the website

Customers are responsible for the accuracy of the information they provide and for keeping their account credentials confidential.

The website may not be used for fraudulent or unlawful activities, or in any way that may compromise its operation.

3D Aircraft Models may suspend an account or refuse orders in cases involving breaches of these Terms, attempted fraud, misuse of services or conduct that may cause harm to the website, the seller or other users.

16. Communications

Order-related communications are sent to the contact details provided by the customer during checkout.

The customer is responsible for ensuring that the email address supplied is correct and for checking the spam or junk folder where, with magnificent digital efficiency, useful messages often go to disappear.

17. Force majeure

Luckyplane is not liable for delays or failure to perform caused by events beyond its reasonable control, including natural disasters, war, general strikes, government measures, transport disruptions, public-health emergencies, major network failures or exceptional supplier unavailability.

In such cases, the customer will be informed as soon as reasonably possible. The continuation, modification or cancellation of the order will then be assessed, with any amounts due being refunded where required.

18. Complaints

The communication must include at least the customer’s details, the order number and a clear description of the issue.

19. Governing law and jurisdiction

These Terms and Conditions are governed by Italian law.

For contracts concluded with consumers, any mandatory consumer-protection rules applicable in the consumer’s country of residence remain unaffected.

In disputes involving a consumer, jurisdiction lies with the court of the consumer’s place of residence or domicile where required by applicable law.

For disputes involving professional customers, unless otherwise agreed in writing, jurisdiction will be determined in accordance with Italian law.

20. Changes to these Terms and Conditions

Luckyplane may update these Terms and Conditions to reflect legal, technical, organisational or commercial changes.

New versions apply to orders placed after publication. Orders already concluded remain subject to the terms accepted at the time of purchase.

If any individual provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.
